Agency loses license
after three misrepresentation offenses and deception of a household worker
The Philippine Overseas Employment Administration has cancelled the license of
Greengate Manpower Services Co., which was found liable for misrepresentation
for the third time.
Administrator Hans Leo J. Cacdac said the agency deceived the POEA and the
worker by submitting documents for processing of an OFW as a hospital janitress,
when in truth she was contracted to work as a domestic worker in Saudi Arabia.
Section 2e of Rule I, Part VI of the POEA Rules and Regulations prohibits
misrepresentation, which is defined as furnishing or publishing any false
notice, information or document in relation to recruitment and employment of
OFWs.
Records of the case showed that Greengate deployed the worker as hospital
janitress for its foreign principal, Zahran Maintenance and Operations Co., but
she actually worked as a domestic worker for another employer.
The worker has alleged that she applied with another agency, but was surprised
that her documents were processed for overseas employment by Greengate Manpower
Services Co.
“Greengate, by providing POEA information different from the intended overseas
job, engaged in re-processing and effectively avoided the protective regulations
on the deployment of household service workers,” Cacdac said.
Re-processing, which is prohibited under the POEA rules, is a scheme of
documenting hired workers with the POEA through a job order that pertains to
work different from the actual overseas job or different employer.
As a consequence of the penalty of cancellation of license, the officers and
directors of the agency at the time of the commission of the offense was
disqualified to recruit and deploy Filipinos for overseas jobs. /END
